TERMS AND CONDITIONS OF SALE AND USE

I- General

1-Scope of application
These terms and conditions apply to any purchase, by individuals or legal entities, of a product offered by LS FORMATION FZCO via the Hotmart Platform.
This document, drawn up in the French language, applies, without restriction or reservation, to all sales made by LS FORMATION FZCO on the HOTMART Platform and this, for an indefinite period.
The purpose of these Conditions is to define, delimit and frame the terms of operation of the services and products offered by LS FORMATION FZCO.
Any use of the services and products sold contrary to these provisions entitles LS FORMATION FZCO to suspend, without notice, the User's account or to refuse to create an account on its Website (see definitions below) as well as on all Platforms where the products and services are offered.
No special condition may, except in the case of a formal written exception signed by the persons concerned, prevail over the present general terms and conditions of sale.
In the event of contradiction between different commitments made by the Parties, the present general terms and conditions of sale (GTCS) shall prevail, except in the event of explicit agreement by the Parties subsequent to acceptance of the present GTCS. In any case and independently of the present conditions, the conditions of use and purchase of the Hotmart Site apply.
Should any provision of these terms and conditions be invalid or void, the remaining provisions shall not be invalid or void.
Any subscription to an Offer implies that the User has read and accepted these terms and conditions. Prior to placing any order, the User must acknowledge that he/she has read the GTC and accepts them unreservedly. To this end, no handwritten signature is required.
LS FORMATION FZCO reserves the right to modify these terms and conditions at any time in order to adapt them to the terms and conditions of sale and operation of the Site and Services.
The present terms and conditions apply only to the products and offers proposed by LS FORMATION FZCO on the Hotmart Platform and under no circumstances to the terms and conditions of purchase and use on the LS FORMATION FZCO Site, nor on any other Platform.
LS FORMATION FZCO is bound by the terms and policies applied by Hotmart. The absence of provisions on the operation of the Platform in these conditions does not exonerate the Customer from applying what he has explicitly accepted when subscribing to his Hotmart account.
2- Definitions / Lexicon

Customer : Refers to any person purchasing a Product from LS FORMATION FZCO on the Platform.
Content: Refers to all information contained on HOTMART's LS FORMATION FZCO page intended for Users who have subscribed to an Offer.
Order: Constitutes any purchase of a product or service offered on Hotmart's LS FORMATION FZCO page.
Personal data: Refers to all information relating to an identified or identifiable individual.
Personal space: Any individual or legal entity with an account on the Platform, access to which is subject to login details.
Offer: Refers to all services and products offered on the LS FORMATION FZCO page of Hotmart that can be ordered.
Platform: Refers to the www.hotmart.com website.
Site: Refers to all LS FORMATION FZCO sites, web pages and online services, namely :

LS FORMATION FZCO: Company, service provider behind the creation and management of the Site and offering Products on Hotmart.
User: Any person who visits the Platform.

4-Purpose

LS FORMATION FZCO provides online training in the field of entrepreneurship. The said training courses can be ordered on the LS FORMATION FZCO Site but also on third-party Platforms such as Hotmart.
LS FORMATION FZCO is a professional independent of Hotmart and offers its products on the Platform. The products are training courses, each including videos and other resources.
LS FORMATION FZCO may call upon the services of external professionals and/or external contributors in order to carry out its training courses, which the User and/or the Customer accept(s) and acknowledge(s).
5. Offers

5.1. General

The Products and Services available on the Platform are those offered on the day of consultation of said Platform by the Customer according to the conditions, contents and availability indicated. LS FORMATION FZCO reserves the right to modify the Offers without having to notify the Platform User, provided that these modifications do not affect an Offer that has been subscribed to.
LS FORMATION FZCO may apply special offers and exceptional discount periods in accordance with the terms and conditions indicated on the Platform and accessible to all Users (duration, terms and conditions of application, etc.). Failure to use the training courses, modules, tools or software offered as part of a promotion may under no circumstances generate a discount or refund, given that they are free of charge. Unless otherwise stipulated in the specific terms and conditions of subscription to an Offer, access to the Offers subscribed to is subject to receipt of payment of the first instalment.
5.2. Training courses
The Trainings and their content are those appearing on the site and the Platform on the day of consultation by the User. LS FORMATION FZCO reserves the right to withdraw or modify the Training Courses offered at any time. Each Training Course is described on the Platform and the User acknowledges that he/she is aware of their content, terms and conditions of purchase, access and payment at the time of purchase.
Each Training Offering constitutes a training module or a training course in its entirety accessible online in accordance with the activity carried out by LS FORMATION FZCO and whose content is detailed on the Platform and the Product page prior to any order.
Access to group coaching for 6 months from date of purchase.
6. Rates
The applicable rates are those indicated on the Platform on the day of the Order by the Customer. The applicable payment terms and pricing conditions are those indicated in the Platform's Terms and Policies.
LS FORMATION FZCO is not involved in any way in the payment process.
7. Terms of payment
All orders may be paid for by any of the payment methods offered on the site. Any order placed with payment facilities will be subject to payment by the payment service used by the Site. If the direct debit is rejected, three successive payment attempts will be made. After these three attempts and in the absence of regularization, access will be blocked. However, unpaid instalments will be due as soon as the Customer has had access to the full content of his order at the time of payment of the first instalment. The Customer remains liable for the full amount corresponding to the initial order. Refusal to pay outstanding instalments will expose the Customer to legal proceedings. The Customer will be banned from the Site and from any Service or Training offered by LS FORMATION FZCO.
Depending on the payment method selected by the Client, additional taxes and bank charges may be added, independent and external to the payment solution on the one hand and LS FORMATION FZCO on the other. Any dispute must be made with the issuing bank.
8. Cancellation and refund
Under no circumstances may the Customer request a cancellation or refund once he/she has begun to use the product or service, which constitutes "digital content not provided on a physical medium whose execution has begun".
Consequently, any request for cancellation and reimbursement must be made, at the latest, when the order is validated by the Customer. Once the Customer has validated his/her order, he/she has expressly waived any request for cancellation and reimbursement.
9. Protection of personal data

a-General provisions
LS FORMATION FZCO undertakes to comply with current and future legal and regulatory provisions applicable to the protection of personal data. LS FORMATION FZCO undertakes to keep the User's or Client's contact details confidential.
In addition to the provisions indicated in these GTC, the Platform may apply its own conditions in terms of conditions and data retention, accepted by the Client when creating its personal space.
LS FORMATION FZCO is not responsible for the terms and conditions of data storage by the Platform, an independent professional outside its business.
b-Duration and methods of data retention
The data collected from the Customer is kept on the LS FORMATION FZCO database for as long as the Customer's personal account remains active. The information is stored on a server secured by SSL, which has particularly high levels of security and data protection. The archived data constitutes evidence in the event of a dispute by the Customer following an order or in the context of a training course. Any dispute must be lodged within 24 months of the order. Once this period has elapsed, the archived data will be definitively deleted and any action brought against LS FORMATION FZCO will be time-barred.
c- Technical measures
Data is stored on a secure server equipped with an SSL (Secure Sockets Layer) certificate, which generates a data file that encrypts the information communicated by the Customer, as well as all connection data.
d-Right of inquiry
All Users have the right to question, access, modify, oppose and rectify their personal data by contacting LS FORMATION FZCO by post, by e-mail or from their personal space on the Platform.
e-E-mails
Any direct canvassing by a Professional, in any form whatsoever, is subject to the prior consent of the person concerned.
Any e-mail sent by LS FORMATION FZCO is subject to the prior consent of the User whose e-mail address has been communicated on the Site or Platform.
f-Prospecting for partners
LS FORMATION FZCO undertakes not to communicate the Customer's information to its partners.
10. Intellectual property rights
All Users acknowledge that they only have the right to use the information in accordance with these General Terms and Conditions of Sale. The User acknowledges that he/she only has the right to use the training courses sold by LS FORMATION FZCO (their content, functionalities, all elements whether visual or audio, texts, layouts, illustrations, photographs, documents as well as all underlying technology) but also all elements that may be offered when purchasing a product (access to private areas, coaching sessions, etc.). The same applies to all content and documentation to which the Customer may have access or which may be communicated to him/her when purchasing a Service or Product. All Users acknowledge that only LS FORMATION FZCO has the right to sell its training courses, and any transmission of information or attempt to sell, in any way whatsoever, is formally prohibited. Any translation, adaptation, transformation, reproduction, modification without the consent of LS FORMATION FZCO is strictly forbidden and exposes its author to legal proceedings. Any study of the solution proposed by LS FORMATION FZCO and any reverse engineering activity are strictly forbidden.
11. Liability
LS FORMATION FZCO shall not be held liable under any circumstances for the direct or indirect consequences, whether to persons or property, of a malfunction of the Platform and its services. LS FORMATION FZCO is in no way liable for the direct or indirect consequences, whether to persons or property, of any damage caused by the use of the Platform or the application of its features and content on tools suggested or not by LS FORMATION FZCO. LS FORMATION FZCO cannot be held liable in the event that Users fail to comply with the obligations of these General Terms and Conditions of Sale. LS FORMATION FZCO may not be held liable in the event of misuse of the services offered, their content or any cause outside LS FORMATION FZCO's control.
LS FORMATION FZCO is only bound by an obligation of means with regard to the availability of its Site and its tools, functionalities and modules and in no case to an obligation of result with regard to its content and the use that the User may make of it. LS FORMATION FZCO provides lessons, methods and techniques for which the results are variable and depend on the use made of them and the context in which they are used.
In any case, LS FORMATION FZCO cannot be held responsible for the methods of use of the Platform, for which it is in no way responsible. Any action relating to the Platform or its use must be addressed to Hotmart and under no circumstances to LS FORMATION FZCO.
LS FORMATION FZCO can in no way be held responsible for the use made of any tools suggested and/or made available to the Client. In the event of the use of a trader's solution, the User acknowledges that LS FORMATION FZCO can in no way be held responsible for any losses linked to its use and strategy. The trend information communicated on the solution is provided for information purposes only, and in no way constitutes an exact science, nor does it constitute true and reliable information, as it is subject to unforeseeable and irresistible hazards and external factors beyond the control of LS FORMATION FZCO. The risk taken by the Client is totally external to LS FORMATION FZCO, which does not verify or monitor the actions taken by the User. It is the User's responsibility to ensure regular monitoring of the actions and positions decided and configured.
12. Right of withdrawal and withdrawal period
The right of withdrawal is the possibility for a Customer to change his or her mind about a purchase made remotely, for a period of 14 days. However, exceptions to this principle of the right of withdrawal apply, notably in the case of contacts "for the supply of digital content not provided on a tangible medium, the performance of which has begun after the consumer's express prior agreement and express waiver of his right of withdrawal". When validating his/her order with LS FORMATION FZCO , the Customer acknowledges that he/she waives his/her right of withdrawal in order to benefit immediately from the content of his/her purchase.
13 - Warranty
Our program is firmly committed to the success of its participants, offering a solid 12-month guarantee.
This guarantee means that in the absence of tangible results within a maximum of one year, participants are eligible for a full refund of their investment.
To benefit from this option, participants must demonstrate rigorous and consistent application of the methods taught during the program.
The specific criteria for refund eligibility are as follows:
1- The participant must provide concrete evidence of the application of the strategies and techniques acquired during the program.
2- Proof of investment of at least 2,000 euros in advertising on platforms such as Facebook and Google, without having acquired at least four customers.
3- Proven attendance at at least 20 hours of group coaching sessions is required.
4- The participant must have created a concierge company and, if unsuccessful, provide documents attesting to its dissolution due to inactivity.
14. Force majeure
LS FORMATION FZCO shall not be held liable if the non-performance or delay in the performance of any of its obligations described in these terms and conditions is due to force majeure.
15. Applicable law
These General Terms and Conditions are governed by the laws of the United Arab Emirates.
II. Terms and conditions of use of the Site

1- Customers
The Customer acknowledges that he/she is of legal age and legally capable. He/she undertakes to make appropriate use of the Products and Services and to provide truthful information about his/her structure, contact details and any other information communicated whenever he/she is requested to do so. The User acknowledges that the information provided concerns his/her person and in no case that of a third party, and that the bank details provided are his/her own and have in no way been obtained illegally or fraudulently. The User is obliged to update his/her information and bank details immediately in the event of any modification.
The User undertakes not to make any incoherent, defamatory, insulting or misleading statements or any content that is illicit, inappropriate, insulting, contrary to morality, public order, good faith or contrary to these general terms and conditions. The User undertakes not to make any insulting or inappropriate remarks likely to harm LS FORMATION FZCO, whether on the Platform, the Site, the software or on any other website, forum or medium.
The User acknowledges that any breach of these provisions may justify the immediate deletion of the Customer from all member areas, zones, groups and software to which he/she may have had access, without any reimbursement being requested or granted.
Modifications, malfunctions and anomalies in services and tools
LS FORMATION FZCO may modify the characteristics, presentation and content of offers, products, services and any tools and accessories made available to the Customer. In the event of a breakdown in service and access to any products and services, LS FORMATION FZCO undertakes to restore services within 24 working hours of being notified of the malfunction. However, LS FORMATION FZCO may not be held responsible for malfunctions due to technical contingencies beyond its control, force majeure, power cuts, or interruptions due to interventions by other service providers (notably the supplier). The Customer undertakes to respect the proper operation of the Site and acknowledges that any attempt to damage the Site may result in legal action. Thus, it is forbidden to carry out manipulations or non-accidental actions whose aim is to disrupt or hinder the proper functioning of the Site and its Services. The same applies to any transmission of viruses and/or communication of files or non-accidental data with the aim of destroying or altering the LS FORMATION FZCO Site and Services.
